These website terms and conditions are additional to, and should be read in conjunction with, all other terms and conditions that we may agree with you as part of your work with MedRecruit. Introduction

By accessing the MedRecruit website or any other website operated by Medenterprises on which this notice is posted (hereafter the website) you agree to be bound by the terms and conditions set out below. MedRecruit reserves the right to vary the information on the website, including these Terms and Conditions, at any time without notice. Your continued use of the website following any changes to the Terms and Conditions indicates your acceptance of those changes.

In the website, a reference to MedRecruit, MedRecruit New Zealand, MedRecruit Australia, "us", "we" or "our" is a reference to any and/or all of MedRecruit Limited (NZBN 9429041813645) or MedRecruit Pty Ltd (ABN 44911819528).

Refer a friend

Through the website, there is the ability to refer a friend. By clicking the refer a friend button a unique code is created and recorded on the user’s profile. This unique link can then be pasted and shared with a friend to register. As a thank you, we will send you a Visa Gift Card (AU) or Prezzy Card (NZ) with a preloaded value for each unique person you refer, dependent on the length of their first placement*. By participating in Medrecruit’s Friend Referral Programme you agree to the below terms & conditions;

  1. You must be registered with Medrecruit at the time of making the referral, two doctors cannot sign up and refer one another
  2. A referral can be made by sharing the unique code on your profile dashboard, verbally to your Solutions Specialist, or by email to your Solutions Specialist or to info@medrecruit.com
  3. Referrals are not valid if the candidate being referred is not a registered doctor
  4. Referrals are not valid if the referrer and person being referred are the same person
  5. Referrals are not valid if the person referred is already registered with MedrecruitIt
  6. If a referral is registered more than once, the referral bonus will go to the first referrer
  7. A $1,000 Visa gift Card (AU) or Prezzy Card (NZ) will be offered when the referred doctor is successfully placed through Medrecruit for the first time, placed within twelve months and completes one of the following:
  • A successful permanent placement; the doctor’s first placement, when the referred doctor completes the initial four-week, full-time (30-hours plus per week) assignment
  • A successful locum placement; the doctor’s first placement, when the referred doctor has worked full-time across 25 days within twelve months of their referral
  1. For first placements three days or less, that are completed within 12 months of being referred, Medrecruit will award the referring doctor 5,000 points
  2. For first placements 4-24 days, that are completed within 12 months of being referred, Medrecruit will offer the referring doctor a $200 Visa Card30 business days of their referred doctor fulfilling the above requirements
  3. The referring doctor will be contacted within 30 business days of their referred doctor fulfilling the above requirements
  4. Medrecruit reserve the right to terminate or change our Friend Referral Programme at any time and without notice
  5. By accepting these Terms & Conditions and providing us with an individual's details, you agree that you have the authority to provide these details and that Medrecruit will contact the referred doctor. You can read our privacy policy

We reserve the right to change this at any time.

Membership rights

The website provides a service for registration as a user through the creation of an account. User accounts will be typically reserved for hospital staff, qualified doctors and medical students only. We reserve the right to exclude any person from account registration at our sole discretion.

If you are an individual who is an employee, shareholder or director of a 3rd party organization which is currently, or may reasonably be expected to become, a competitor of MedRecruit you are hereby excluded from the right to register through the creation of an account.

Lawful purposes only

You may use the website for lawful purposes only. You shall not use the website in such a manner that it may disrupt the use of any other person. You may not use any technology of techniques designed to circumvent user authentication/authorization or any other security measure.

Copyright in all information on this site, unless otherwise indicated, is owned by MedRecruit. The information provided by the website to you may be proprietary in nature. You represent and warrant to us that you are not and shall not be a competitor of MedRecruit and agree not to share our confidential information with any competitors.

In some cases MedRecruit has procured a license to use certain content, images or video on the website. Rights in this content remain the property of their original owner.

You shall not use any technology or techniques including but not limited to screen scraping designed to collect information, in bulk form, from the website.

Links to other sites

From time to time the website may link to other 3rd party websites. These links may be in the form of a clickable hyperlink or other approaches that include 3rd party content in pages on the website. MedRecruit takes no responsibility for any information contained in these 3rd party websites. The content, accuracy and opinions expressed in such websites are not necessarily checked, monitored or endorsed by MedRecruit. Linking to a third party website does not indicate any endorsement of that website, its content or any associated organizations.

Privacy

MedRecruit is an Agency for the purposes of the Privacy Act 2020. All personal information that you supply to MedRecruit will be treated in accordance of that Act. In the course of providing you with our products and services, we may collect personal information from you. We will collect, hold and use your personal information in accordance with our privacy policy. You have the right to ask to see information that MedRecruit holds about you and if you believe that the information is incorrect to ask that we correct it.

Partner offers

From time to time we may make available offers from selected partners. We make no representations or warranties concerning these Partner Offers and you agree that we are not responsible or liable for any loss or damage of any sort incurred, or as the result of the delivery or display of the Offers. We are not responsible for the terms and conditions of Partner offers nor are we responsible for delivery of the goods or services. We make a good faith effort to screen all Partner Offers to provide the best experience for our members however we are not responsible for dealings between you and a partner organization. You are responsible for and must carefully read and assess the terms of any partner in light of your particular individual circumstances.

User submitted content

You are solely responsible for any content and other material that you submit, publish, display or link to the website. This includes any files or images that you might upload. You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information on the Site. You are responsible for ensuring that any content that you post is in compliance with all local laws and regulations. You agree to indemnify us from any claims that may arise as a result of content that you have posted.

You agree that by posting any content or other material to the site you grant us an irrevocable, royalty-free, worldwide, perpetual license to use that content.

We are under no obligation to publish content that you may provide us and reserve the sole right to determine if and when content is posted and removed.

Rewards points

MedRecruit Ltd offer a rewards points program to select persons. Participation in the rewards points program will be typically reserved for qualified doctors and medical students only. We reserve the right to exclude participants at our sole discretion.

Points which are not used to claim a reward within 12 months after the end of the month, in which the points were recorded, will expire and be deducted from the members points balance without notice.

Reward points have no cash value and are not transferable for cash.

MedRecruit Ltd reserve the right to alter the nominal value of any points without notice.

MedRecruit Ltd give no warranty to the continuing availability of the rewards points program, and reserve the right to terminate it by providing at least 14 days’ notice to participants.

Unsolicited Electronic Messages Act 2007

The Unsolicited Electronic Messages Act 2007 aims to stem the flow of unsolicited commercial electronic messages. When MedRecruit sends you messages about our products, services or promotions it is because we believe you have provided either express or inferred consent for us to send these emails. MedRecruit would like to continue to keep in contact with you, however, should you not want to receive these messages, you should use our contact us form to let us know.

From time to time medrecruit will help to enhance your experience by setting up recommended job alerts. We do this to enhance your experience to ensure you have the most relevant alerts for you.

Limitation of liability

If you are dissatisfied with the website, with any content on the website or with these terms and conditions then your sole and exclusive remedy is to discontinue using the website.

Except insofar as any liability under statute cannot be excluded, none of MedRecruit, any of its employees and agents, or any other party accepts any responsibility or liability for any direct or indirect loss or damage that may result from any errors or omissions on the website, reliance on information on the website, or access to, the use of, or inability to use, the website.

If, notwithstanding the clause above, a court of competent jurisdiction holds us (or any of our officers, employees or agents) liable in respect of any matter arising out of or incidental to your use of the website or these terms and conditions, whether that liability arose in tort (including negligence), contract, equity or on any other basis, the total aggregate liability will be limited to NZD$1.00.

Governing Law

These terms and conditions are governed and construed in accordance with New Zealand law and when accessing this website you accept the exclusive jurisdiction of the New Zealand courts.
